AVELAR BY-LAWS & OPERATING RULES

RIGHT OF ACCESS:

Without limitation, the administrator of the "Avelar" condominium and his assigned employees will have the right to enter the common areas for the purpose of carrying out administrative and maintenance tasks and obligations.

WORKERS WITHIN APARTMENTS: 

Any person who is going to carry out work within a unit must register at the security booth and leave a copy of their identification. The hours to carry out work are Monday through Friday from 10:00 a.m. to 5:00 p.m., Saturday from 11:00 a.m. to 5:00 p.m. and Sundays are not allowed.

USE OF BALCONIES: 

It is only allowed to have furniture or potted or hanging plants on the balconies, they cannot be used as warehouses or hang objects, nor can pets stay unsupervised or at night in these areas.

RESTRICTIONS OF USE IN COMMON AREAS:

The right of non-exclusive use of the owners and/or users of the common areas of the "Avelar" condominium is subject to certain reasonable restrictions including, but not limited to the following:

 A) NOISE:

Stereo radios and televisions must remain at a volume that does not disturb the tranquility and comfort of the residents. Users and children must not cause any type of disturbance that affects any user of the "Avelar" condominium. Noise must be kept to a minimum between 10:00 pm and 10:00 am throughout the week.

Any user who is harassed by another user must register a complaint with the administrator and not with the person who is causing the nuisance.

 B) BEHAVIOR:

Any user (including children) must abide by all the rules and regulations of the "Avelar" condominium, including specific rules included by the administrator for the use of the pool, common areas and recreation.

Users must conduct themselves according to the standards of conduct, whether or not they are specified in the regulations.

 C): DRESS CODE:

Adequate and appropriate attire is required at all times, in and around the pool, recreation and leisure facilities.

 D) VISITS:

Condominium "Avelar" is a private residence. Access to the condominium by unauthorized persons is prohibited. The number of visitors allowed in a unit at the same time may be limited by the administrator, and all visits must be registered with the administrator. In some cases the administrator will have the right to charge a fine for excessive visitors at his sole discretion.

 E) GLASSWARE:

The use of glass cups, bottles and other glass items are not allowed in, around the pool and other common areas.

 F) CHILDREN:

Children under 12 years of age must be accompanied and supervised at all times by an adult while they are in the common areas, including but not limited to the pool area. Any user is responsible for the behavior of minors under their care and must ensure that they do not disturb, damage or cause discomfort or property of others. Children under 12 years of age are not permitted in the exercise room.

 G) STORAGE:

It is forbidden, but not limited, to hang towels, sports equipment, clothing and any other item on the balconies and/or terrace railings unless otherwise specifically allowed in these rules.

Any items, including shoes, sandals, dirty clothes, trash, strollers, bicycles, rugs, surfboards, and any other similar items, must be stored in the units and not in hallways, balconies, or any common area. The furniture in common areas placed by the developer may not be removed by any resident or user.

 H) GARBAGE:

Residues, scraps and trash must be deposited in the containers designated for this, located in the areas designated by the developer. Food waste must be wrapped to avoid the presence of pests and rodents. It is forbidden to throw objects and/or rubbish from the balconies or windows or allow them to fall on balconies or decks below.

 I) POOL FURNITURE:

The use of chairs, lounge chairs and other furniture will be under the system: "first come, first served".

Chairs, lounge chairs and other outdoor furniture may not be reserved for long periods of time, simply by placing personal items on them. Any chair, cot or outdoor furniture that remains unoccupied for more than one hour, even if personal items are placed on them, will be considered unoccupied and may be used by another user. The administrator will not be responsible for the loss of personal belongings left in the common area. Occupants and guests are responsible for cleaning up after themselves, including restoring furniture and amenities to their rightful place, cleaning the barbecue if they used it, and removing their garbage and recycling.

 J) FOOD AND DRINKS:

The consumption of drinks and food will be only within the units and other areas designated by the resident administrator. Drinks and food are not permitted in the pool.

 K) RISKS:

The use of common areas, including, but not limited to, the pool, recreation and leisure areas, its equipment, elevator, stairs, and lobby will be at the sole risk of the user. The administrator and the developer will not be responsible for your safety and that of your guests. Each owner will be responsible for their safety at all times. Since wet areas are dangerous, users should be especially careful around swimming pools and wet areas.

 I) PETS:

One Domestic pet up to 10 kg, specifically a dog or cat (NOT exotic animals such as birds or reptiles) will be allowed in the private unit and not in common areas except for transiting inside and outside when the pet must be on a leash. Up to two pets or a pet weighing more than 10 kg may be considered but must be approved by the strata and all pets must be registered with the strata.

It is not allowed to own animals that, due to their number or breed, endanger the safety, health or comfort of the condominium for the other tenants. Pet owners will be responsible at all times for the actions of their pets or animals that are brought into the "AVELAR" condominium.

 M) POOL:

The daily hours of the pool will be from 09:00 a.m. to 9:00 p.m. There are no lifeguards in the pool, and users do so at their own risk.

 N) PARKING AND WAREHOUSES:

The use of parking spaces and warehouses are for the exclusive use of the unit, renting them to a third party is not allowed, nor is it allowed to use spaces that do not correspond to each unit. If the unit is rented, only one vehicle will be allowed to enter, which must be parked in the space corresponding to the rented unit. Parking spaces must not be used to repair vehicles, boats and other goods and/or for storage of said goods.

 O) USE:

The owners of the "AVELAR" condominium may use the goods, facilities and services associated with the condominium only for personal use in accordance with the legal documentation and not for any type of commercial use and/or any other use.

 P) RENTAL OF THE UNITS:

The rental of the unit will be allowed with a maximum of two people per bedroom plus two people per living room (six people per two-bedroom unit) and will only allow stays of five nights or more (not less than five nights).

 Q) FINES & PENALTIES:

Failure to comply with the bylaws may result in a fine or penalty to the owner starting at 1000 pesos and payable within 30 days of notification. Appeals must be submitted in writing to the Administrator and are subject to review by the HOA Board of Directors.
